Attorney Work Product

Attorney Work product is a “writing that reflects an attorney's impressions, conclusions, opinions, or legal research or theories.” Work product that meets this definition is not discoverable under any circumstances. Work product does not include non-derivative or non-interpretative materials of an evidentiary nature such as written or recorded statements of prospective witnesses or summaries of them. In other words, witness statements to prosecutors and defense lawyers are discoverable, although counsel's impressions about these witnesses are not.
