Public Intoxication
Public Intoxication is often called "Drunk in Public," "Disorderly Conduct," "Drunk and Disorderly," or "Under the Influence in Public." Public Intoxication is a crime in California and is prosecuted under Penal Code section 647(f). The Penal Code describes Public Intoxication as someone who is intoxicated or under the influence of alcohol, drugs, controlled substances, or toluene (glue) and is unable to care for his or her safety or the safety of others, or by reason of such intoxication or influence interferes, obstructs, or prevents the free use of a street, sidewalk, or other public way. This offense in California is a misdemeanor punishable by up 180 days in county jail and a $1000 fine.
