About

Always a Criminal Defense Lawyer – Never a Prosecutor

Stephen G. Rodriguez is a career criminal defense attorney. He has never been a police officer, criminal prosecutor or worked for law enforcement.

His focus has always been on representing individuals charged with committing a crime. Some former prosecutors brag about their 93% success rate (for convictions) and suggest that their experience makes them a better criminal defense attorney. Mr. Rodriguez disagrees. Prosecuting and defending a criminal case requires very different skill sets.

A prosecutor's mindset and philosophy is to prosecute and convict, while a defense lawyer’s mindset and philosophy is to defend and acquit. Mr. Rodriguez has never prosecuted or convicted anyone; he has devoted his career to defending people. Through the years, Mr. Rodriguez has represented individuals in a broad variety of criminal matters, which has provided him with an in-depth understanding of the intricacies of California criminal law.

Mr. Rodriguez has a rule of thumb as a defense lawyer and that is that he does not ask his client what happened. He doesn’t care about that. It is not important nor is it relevant. The only thing that matters is what the government/prosecutor can prove.

“After 20+ years of being a criminal defense lawyer, my passion and commitment for helping those accused of crimes remains the driving force in my life. I am thankful for the knowledge, skills and experience I have acquired. My continued legal education each year allows me to gain an even better understanding and competence to assist my clients and bring them the confidence and fighting spirit that they entrust in me and my legal team. Every opportunity to negotiate a successful plea, obtain a not guilty verdict or a dismissal of the charges gives me the strength and courage to work even harder for their benefit. Other than my loving wife and daughter, my practice will always be the main priority in my life. That is the promise and commitment I make to each of you.”

Mr. Rodriguez has provided legal commentary on the following shows:

  • Anderson Cooper 360

Why I Am a Criminal Defense Attorney

I became a criminal defense attorney because I believe in standing up for people when they are facing one of the most difficult moments of their lives. Every case is, at its core, a David versus Goliath battle—the individual against the full power of the government. The prosecution has vast resources: investigators, experts, forensic laboratories, advanced technology, and the backing of law enforcement agencies and task forces—all within a system built to secure convictions. My client, on the other hand, is often one person—overwhelmed, outmatched, and facing life-altering consequences.

That imbalance is exactly what draws me to this work. I am motivated by the challenge of standing in that gap—of pushing back against the weight of the system, holding the government accountable, and making sure my client is not steamrolled simply because they lack the same resources. Leveling that playing field and giving someone a real chance to be heard is at the core of what I do.

I do not judge my clients based on what they have been accused of. Instead, I take the time to understand their story, their circumstances, and what truly led them to where they are. In some cases, people are wrongfully accused. In others, the charges simply do not reflect what actually occurred. Without the right advocate, those distinctions can be lost—and the consequences can be severe.

I put myself in my clients’ shoes because effective representation requires more than legal knowledge—it requires perspective, empathy, and commitment. I approach every case with one central goal in mind: to see if I can improve my client’s life in a meaningful way. Whether that means reducing charges, avoiding custody, or helping them move forward with dignity and a second chance, I take that responsibility seriously.

At the end of the day, this work matters to me. Every case matters. Every client matters. And the opportunity to stand beside someone, fight for them, and help shape a better outcome is something I take personally.
