Administrative Hearing
An Administrative Hearing is held in front of a Hearing Officer, Hearing
Administrator, Administrative Law Judge or some other representative of
the agency who has the authority to administer oaths, hear testimony and
determine agency-related questions of fact. Individuals accused of drunk
driving in California have the option of appearing at an Administrative
Hearing to determine the circumstances surrounding the DUI arrest. The
Administrative Hearing is completely separate from the DWI criminal proceedings.
