Alternative Sentencing Options in California

Who is Eligible for Home Confinement?

Participation in electronic monitoring may be court-issued or your lawyer can ask the court to have you assessed for eligibility. Even if you are already in jail, you may be eligible to serve out the rest of your sentence on house arrest. The Los Angeles electronic monitoring program considers offenders for house arrest who have committed either felonies or misdemeanors. Offenders with a history of violence, or who have committed drug crimes involving sales or manufacturing, or sex crimes are generally not eligible.

Electronic Monitoring Conditions

If you are eligible for house arrest, the court will determine your monitoring conditions—that is, what you are allowed to do while you are being electronically monitored.

Some of your conditions and restrictions may include the following:

  • Most often allowed to go to work and school
  • May be allowed to attend medical appointments
  • May be subjected to alcohol and drug testing
  • May be required to attend an alcohol/drug program
  • May be subjected to curfew restrictions

Once deemed eligible, the County of Los Angeles Probation Department contracts with a company that you will be referred to in order to obtain your monitoring equipment.

How Does Electronic Monitoring Work?

The company providing the electronic monitoring device will provide status and non-compliance reports to the Probation Department. Depending on your living situation, your equipment will operate through your telephone, wirelessly or through a GPS system. You will be required to wear an electronic bracelet with a sensor on your ankle at all times, and the distance you can go from home is programmed into the bracelet.

If you try to tamper with the system or go beyond the programmed area, it will be reported to the Probation Department. Also, please be aware that if you violate your electronic monitoring conditions, you can be re-arrested and put in jail. Although there is a cost to participate in house arrest, the amount can be determined by your probation agent using a sliding fee scale that will be based on your ability to pay.

What if I Violate the Terms of my Home Detention?

When you are put on house arrest, you will be fitted with an electronic monitoring device. If you tamper with this device (i.e. try to take it off) or go beyond the designated boundaries, this information will be reported to your probation officer. Under California probation laws, your probation officer does not need to rely on an arrest warrant in order to make an arrest. After being taken into custody, you will need to attend a probation hearing, wherein you would have the change to explain your side of the story.

If the judge decides that you have violated the terms of your house arrest, they could revoke this privilege altogether and order you to serve out the rest of your sentence in county jail or state prison.
