Allegation
Allegations are statements in a Complaint, Indictment or Information that set forth the charges against a defendant. Allegations are assertions of fact without proof. The objective of the plaintiff or the prosecution is to prove the allegations. When something is asserted as a fact that will be proven at trial it is an alleged fact. For example, if the prosecution has alleged that a certain defendant committed murder, one would say, “the alleged murderer.” Once a defendant is convicted, he becomes a murderer who committed murder.
