California Trespass Law
Criminal trespass law is defined in most states as unwanted intrusion onto someone else’s property. In California, criminal trespass law is contained in the subdivisions of California Penal Code Section 602. There is a wide range of conduct that can result in a criminal trespassing charge. These include:

  • Entering or occupying someone land, building or home without permission.
  • Not leaving someone’s land, building or home when they tell you to.
  • Cutting down or take away timber or wood from someone else’s land.
  • Digging up and/or taking away soil from city/county/state land without a license.
  • Tearing down, damaging, mutilating, defacing or destroying signs or notices.
  • Taking oysters or other shellfish from someone else’s land.
  • Taking or injuring farm animals.
  • Opening, tearing down or otherwise damaging someone’s fence, or leaving the gate open on purpose.
  • Entering buildings or other structures without permission.
  • Driving a car on private land.
  • Refusing or failing to leave a public building when the building is regularly closed when asked to do so by an employee, watchman or guard.
  • Skiing on a ski trail that is posted closed.
  • Not paying for and then refusing to leave a motel or hotel.
  • Going into an area of an airport that is limited to “authorized personnel.”
  • Refusing to submit to screening at an airport.
  • Refusing to leave a woman’s shelter after being asked to do so.
    Entering or remaining in a neonatal unit, maternity ward, or birthing center located in a hospital or clinic without lawful business there.
  • Intentionally avoiding screening when entering a courthouse or other county, state or city building with controlled access.

Penalties for Criminal Trespassing,
Anyone cited or arrested for California Penal Code section 602 in Los Angeles faces a misdemeanor charge. If convicted, a defendant can receive up to 180 days in county jail, $1000 fine, probation, community service, CalTrans, stay-away orders, and/or restitution.

Defending Your Rights
Although a criminal trespassing arrest might seem minor, it’s not. Criminal trespass is a misdemeanor crime. Even if no county jail time is imposed, the trespass conviction remains on a person’s criminal record. So, there is a lot riding on the defense of a trespassing charge.
