Capital Felony

A capital felony (also referred to as a “capital crime” or a “capital offence”) is a felony crime for which the death penalty can be imposed. If the death penalty is not imposed, the defendant is sentenced to life imprisonment without parole (LWOP.) First degree murder, depending on the aggravating circumstances may be charged as a capital crime. See also, Death Penalty, LWOP.
