Falconer Error

A Falconer Error is a trial court's failure to inform the jury that the defendant must be acquitted of murder if the jury finds the defendant guilty of manslaughter. The term “Falconer Error” is derived from the case Falconer v Lane, 905 F.2d 1129 (7th Cir. 1990).
