Fraud on the Court
Fraud on the court is fraud (deception) involving conduct by any officer of the court (i.e. judge or attorney) that undermines or is intended to undermine the integrity of the judicial process such that the impartial functions of the court have been directly corrupted and compromised. This conduct includes bribing a juror, improperly influencing a judge and the introducing of fabricated evidence. Fraud on the court is serious misconduct because it involves egregious behavior aimed at the heart of our judicial system. A finding of fraud on the court must be willful, deliberate and egregious and supported by clear, unequivocal, and convincing evidence.
