Equal Access Rule

The equal-access rule is invoked as a defense when contraband is found on a defendant's premises, but other people have had the same access to the premises as the defendant. (i.e., the contraband could have belonged to any number of people.) The defendant must show that others in fact had access -- speculation about trespassers on the premises will not be sufficient to bar conviction.
