Cause In Fact

Criminal liability cannot be proved unless the prosecution can show that the defendant's act was a cause in fact of the crime. Cause in fact is determined by showing that “but for” the defendant's actions, the harmful result would not have occurred. See also, But-for Cause, Actual Cause.
