Bain Error

When prosecutor offers her personal opinion regarding the guilt of the defendant, it is referred to as a Bain Error.” If the prosecutor's opinion explicitly states it is based on trial evidence it is not considered “Bain Error.” The term Bain Error comes from the California Supreme Court case entitled People v. Bain (1971) 5 Cal.3d 839.
