Amendment to a Complaint

A criminal complaint is a document that charges a person with a crime. It sets forth the facts that constitute the crime and must be supported by probable cause. If the Prosecutor decides it needs to be altered or corrected after it has been filed, he may amend the complaint. For example, if the Defendant is suspected of committing a battery and a complaint is filed that accuses him of committing battery, the Prosecutor may amend the complaint to include a charge of murder if the victim dies.
