About Dog Fighting Charges

California has tough laws in place pertaining to dog fighting. Penal Code 597.5 makes it illegal to participate in a dog fight, including as a spectator, an owner of one of the dogs, or as an organizer of dog fighting events. Being convicted of being a spectator to a dog fighting event is a misdemeanor that can carry with it jail time of up to one year and a fine of up to $5,000 dollars. Conviction for being a dog owner or event organizer is a felony bringing with it up to three years in prison and a fine of up to $50,000 dollars.

Regarding spectator charges, prosecutors must prove that the spectator was aware that they were at a dog fighting event and had the intent to be there. With dog owners, prosecutors must prove that the owner intentionally trained and kept a dog with the intent of entering it into dog fights, or that he or she instigated dog fighting with the intention of dogs injuring each other. With organizer charges, prosecutors must prove that the organizer utilized a property under his or her control to harbor dog fighting events, or to aid the harboring of dog fighting events. Intent is usually an essential point of attack for a criminal defense team on behalf of those charged with dog fighting offenses. If you or a loved one is facing these serious charges, it is imperative that you contact a knowledgeable criminal defense attorney at once, to get the legal protection you will need for your case.
